These Terms of Service ("Terms") govern your use of Waynebert (the "App"), an AI gaming companion application. By downloading, installing, or using the App, you agree to these Terms.

1. Who we are

Waynebert is operated by Michael Gregory, a sole trader trading as "Waynebert", based in the United Kingdom. In these Terms, "we", "us" and "our" refer to Michael Gregory trading as Waynebert. You can contact us at [email protected].

2. The service

Waynebert is a desktop application that listens to your microphone and reads your screen to provide spoken commentary and companionship while you play games. The App is free to download and use. You may run the App's speech-to-text, language model, and text-to-speech stages locally on your own hardware, through your own remote API keys with a third-party provider, or — once available — through a hosted Waynebert account.

3. Waynebert accounts and credits

The hosted Waynebert account is an optional paid feature and is not yet available. Its sole purpose is to provide a hassle-free way to run the App's functionality on remote models without configuring your own API keys.

When it launches, the hosted account will require you to purchase credits in advance. Credits are consumed as you use the hosted service, are metered by usage, and are non-transferable. Prices, the current rate at which credits are consumed, and any related terms will be published on this site before the feature goes live, and the price shown at checkout is the price you pay.

4. Payments

Paid features are sold through Paddle.com Market Limited ("Paddle"), our reseller and merchant of record, who handles payment processing, sales tax, and invoicing. When you buy credits, your contract of sale is with Paddle, and your purchase is subject to Paddle's own buyer terms in addition to these Terms.

5. Acceptable use

You agree not to use the App to violate the terms of service of any game, platform, or third-party API provider you connect it to, and not to use it for any unlawful purpose. You are responsible for ensuring your use of the App complies with the rules of the games and services you use it alongside.

6. Third-party models and providers

When configured to use a remote API, your microphone transcript and screen captures are sent to a third-party provider for processing:

  • If you use your own API key, they are sent directly to the provider you have configured (for example OpenAI, Anthropic, or any OpenAI-compatible endpoint) under that provider's own terms.
  • If you use a hosted Waynebert account, they are routed through our hosted service to OpenRouter, which in turn passes them to the underlying model provider that serves your request.

We are not responsible for the availability, output, accuracy, or conduct of third-party providers.

7. Disclaimer of warranty

The App is currently in an alpha/beta phase and is provided "as is" and "as available", without warranty of any kind except as required by law. We do not guarantee uninterrupted or error-free operation.

8. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the App.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

9. Your consumer rights

If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, or other applicable consumer law. Refunds for paid features are covered by our Refund Policy.

10. Complaints

If you have a complaint, please contact us first at [email protected] so we can try to put it right. We aim to acknowledge complaints within 3 business days and to resolve them within 14 business days, or to let you know how much longer we expect to need.

Because Paddle is our merchant of record for paid features, you can also raise purchase-related issues with Paddle directly through their order support.

If we cannot resolve a complaint between us, you may be able to refer it to a certified alternative dispute resolution (ADR) provider. We are not currently a member of a specific ADR scheme, but a list of approved ADR bodies is maintained by the Chartered Trading Standards Institute. Using ADR is voluntary and does not affect your right to take a claim to court.

11. Governing law

These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales, and are subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your home nation, and you benefit from any mandatory consumer protections of the country in which you live.

12. Changes

We may update these Terms as the product develops. When we do, we will revise the "last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
